Terms of Enrollment (Flex)

Dual Academy Corp.

Terms of Enrollment: Flex

Effective Date: August 14, 2026 Version: 2.2 Applies to: Flex enrollments, Fall 2026 forward Delaware Public Benefit Corporation • Principal Office: Washington, DC
These are the terms of enrolling a student in Dual Academy Flex classes. We have written them in plain language and kept the legal terms to a minimum, so you can see clearly what you are agreeing to. When you check the boxes on our enrollment form, you accept these terms. For a student under 18, the parent or legal guardian accepts them and is the contracting party.

These terms apply to Dual Academy Flex enrollments. Students in the Live and Campus programs are governed by their signed Enrollment Agreement, together with the Student and Family Handbook and the Privacy Policy.

1.  Your Student’s Classes

  • Dual Academy Flex classes are college classes from NewU University, taught by college professors. NewU University is accredited by the Middle States Commission on Higher Education. College credit is awarded by NewU University on an official NewU University transcript.
  • Whether another college or university accepts NewU University credit is that institution’s decision. We do not guarantee transfer.
  • A NewU University admission letter is issued after your student completes one class, not at enrollment.
  • The college record for the class is held by NewU University. Rights in a college record belong to the student rather than the parent, regardless of the student’s age. A parent who wants access asks the student for a written release. Policy 23 of the Student and Family Handbook explains this.
  • Flex enrollment does not award a high school diploma. Your student remains enrolled at their current school or homeschool program, and your family remains responsible for any compulsory attendance requirements.
  • Assignments and assessments must be completed by the deadlines the professor posts, and by the end of the semester, to earn credit.
  • Dual Academy provides documentation of enrollment and credit on request.

2.  Orientation and the Semester

Two dates to put on your calendar

Orientation is Monday, August 24, 2026. All Flex students are expected to attend.

Classes begin Monday, August 31, 2026.

Semester dates are published in the Dual Academy Academic Calendar at dualacademy.org.

3.  Attending Class

  • Students may attend each class live online, or watch the recording of the class.
  • A student attending live is expected to have their camera on. Class is a discussion, not a broadcast, and everyone present should be able to see everyone else.
  • A student who prefers not to appear in a recording may attend by watching the recording instead, subject to the assignment and assessment deadlines in Section 1.
  • A student who needs a different arrangement should contact the Head of School.

4.  Lecture Recording

Class lectures are recorded, including video, audio, and whatever the professor presents on screen. Only lectures are recorded. Advising, wellbeing, and disciplinary conversations are not.

Classes are taught in NewU University classrooms that connect students attending online with students attending in person. Those classrooms use a 360 degree camera and microphone placed among the seats, so a recording of a class with in-person attendance captures the room and the people in it, including students other than your own. Google Meet shows an on-screen indicator to everyone for as long as recording is active, so anyone present can see that a lecture is being recorded.

Who holds recordings

NewU Inc. is the custodian of lecture recordings. They are stored in NewU Inc.’s Google Workspace for Education environment with sharing restricted. They are not public, not posted to the internet, and not searchable.

Who can see them

The professor of the class, the students enrolled in that class, and designated academic administrators of NewU University and Dual Academy. Students may watch recordings of their own classes. Students may not download, copy, re-post, or share a recording with anyone outside the class.

How long we keep them

Recordings are kept for one academic year and then deleted, unless a recording must be preserved for an investigation or as required by law. This is Policy 15 of the Student and Family Handbook.

What we do not do with them

Recordings are not sold. They are not used for advertising or marketing. They are not used to train artificial intelligence or machine learning models.

Exams and proctoring

Some Flex classes include exams or quizzes taken online. Dual Academy may use remote proctoring software for those assessments. Remote proctoring runs inside the Chrome browser and may record the student’s webcam, microphone, and screen during the assessment, and may limit other browser activity while the assessment is open.

The specific software in use, what it records, who may review it, and how long recordings are kept are published at dualacademy.org/tech, and a class that uses proctoring says so in its syllabus. Proctoring recordings are education records. They are not sold, are not used for advertising or marketing, and are not used to train artificial intelligence or machine learning models.

You may ask what recordings exist of your student, ask to review them, or ask us to delete one. Write to [email protected] and we respond within a reasonable time, and in any event within 45 days. If we cannot delete a recording, for example because it is also another student’s education record or must be preserved, we will tell you why.

5.  Who Is in the Class

Flex classes are college classes. Your student may share a class with adult NewU University degree students and with students in Dual Academy’s Live and Campus programs, both in the room and online. Policy 23 of the Student and Family Handbook governs this shared environment. Under it, an adult student may not initiate private direct messages, social media contact, or off-platform contact with a student they know or reasonably believe to be a minor; romantic or sexual conduct between an adult student and a minor student is prohibited and is reported under Policy 18; an adult student may not provide alcohol, cannabis, or tobacco to a minor student, on or off school premises, or transport a minor student without written guardian consent; and faculty teaching a shared class are told which students are minors and apply those rules with that information. Your student’s age is treated as confidential and shared only with staff who have a legitimate educational need. Policies 17, 18, and 19 set the child protection, mandated reporting, and adult boundary rules that bind our faculty and staff.

6.  Technology and Accounts

Your student needs a computer, the Google Chrome browser, a working webcam and microphone, and home internet of at least 5 Mbps down and up. The full list is published at dualacademy.org/tech and is part of these terms.

Dual Academy issues each student an @newu.university Google account at enrollment. It is used for class access, Google Meet, and Populi, where assignments, grades, and attendance live. Class communication happens on that account.

7.  Payment, Refunds, and Deferrals

Payment

  • Tuition is due at enrollment unless we have issued you a written payment plan. Monthly payment plans are available: text 202-968-1005 or email [email protected].
  • A payment plan is a binding payment schedule. Where a payment plan agreement and these terms differ, the payment plan agreement controls, including the non-refundable deposit of $100 per class described in Policy 29 of the Student and Family Handbook.
  • Failed payments pause enrollment until resolved, under Policy 29 of the Student and Family Handbook.

Cancellation and Refund

  • You may cancel within 14 days of purchase for a full refund of tuition, less the payment processing fee charged to us, which is 2.9% plus $0.30 per transaction.
  • The cancellation window closes at 12:00 AM ET on the first day of the semester, even if fewer than 14 days have passed since purchase.
  • After the window closes there is no refund, whether or not the student attends or completes the class.

Deferral

  • Instead of cancelling, you may defer an enrollment to another Flex class if you notify us before 12:00 AM ET on the first day of the semester.
  • The replacement class must begin within 12 months of the original enrollment date.
  • If the replacement class has a different price, the student pays the difference or receives a credit for the balance. Credits must be used within 12 months of the original enrollment date, have no cash value, and are not refundable.
  • Each enrollment may be deferred once.

If Dual Academy Cancels a Class

We do not guarantee that a listed class will run in any semester. If we cancel a class for insufficient enrollment or any other reason, you may choose a substitute class or a full refund of tuition paid for that class, including processing fees.

If a Student Is Dismissed for Cause

A student dismissed for a violation of the Code of Student Conduct receives no credit and no refund; that process is in Policy 52 of the Student and Family Handbook. The same applies to dismissal for an academic integrity violation under Policy 32, or for academic reasons under Policy 45.

How to Request

Email [email protected] with your student’s name and enrollment date. Refunds are processed within 10 business days. Deferrals are confirmed by reply email.

8.  Communications

You authorize Dual Academy to contact you and your student by email and text message about enrollment, classes, payments, and academic progress. Message and data rates may apply. Reply STOP to opt out of texts, or HELP for assistance. Full messaging terms are at dualacademy.org/sms-terms.

9.  Policies That Apply

The Dual Academy Student and Family Handbook, published at dualacademy.org/policies, and the Dual Academy Privacy Policy, published at dualacademy.org/privacy, are both incorporated into these terms by reference. Where these terms and the Handbook address the same subject, these terms control.

A PDF copy of the Handbook is available on request from [email protected].

10.  Dispute Resolution

Internal First

Most things get resolved by talking. If something feels off, raise it through the grievance process in Policy 44 of the Student and Family Handbook. All disputes must be exhausted through that internal process before any external action is initiated.

Binding Arbitration: please read carefully

If a dispute is not resolved internally, you and Dual Academy agree that all remaining disputes will be settled by binding arbitration, not in court. Arbitration is administered by the American Arbitration Association under the AAA Consumer Arbitration Rules then in effect. The arbitration takes place in Washington, DC. The arbitrator’s decision is final and binding on both parties, subject only to the narrow grounds for review under the Federal Arbitration Act.

Class action waiver. You and Dual Academy each agree that any dispute will be brought in your individual capacity only, and not as part of a class, group, collective, or representative action. You waive any right to participate in a class proceeding against Dual Academy. The arbitrator may not consolidate claims brought by different parties.

Jury trial waiver. You waive the right to a jury trial for any dispute covered by this arbitration agreement.

Arbitration Costs

Dual Academy will pay all AAA filing and administrative fees and all arbitrator fees, except that you will pay a filing contribution equal to the filing fee for a small claims case in DC Superior Court at the time you file. Dual Academy will waive your filing contribution on your documented showing of inability to pay. The arbitrator may reallocate fees, including fees Dual Academy would otherwise pay, against any party whose claim or defense the arbitrator determines was frivolous or brought in bad faith.

Mass Arbitration

If 25 or more arbitration demands are filed against Dual Academy by or with the coordination or involvement of the same law firm or organization, and the demands raise common questions of law or fact, the demands are administered together in staged batches rather than all at once. The parties first arbitrate a bellwether batch of up to 10 demands chosen by the claimants and up to 10 chosen by Dual Academy. After the bellwether decisions, the parties use the outcomes to attempt a global resolution of the remaining demands through mediation. Demands awaiting their batch are not active: their AAA filing and arbitrator fees do not accrue, and any applicable limitations period and fee deadline are tolled, until those demands are activated in a later batch.

What Is Not Covered by Arbitration

Nothing in these terms limits the right of either party to bring or pursue:

  • Claims of sexual abuse, child abuse, or physical injury to a minor student, which may be brought in court.
  • Any individual claim in small claims court, if within that court’s jurisdictional limits.
  • Any action for injunctive or equitable relief in court, including to protect intellectual property under Policy 38.
  • Any reporting obligation or right under mandated reporter law, including D.C. Code section 4-1321.02 and equivalent state laws.
  • Any complaint to Cognia or, where applicable to NewU University postsecondary credit, the Middle States Commission on Higher Education or the District of Columbia Higher Education Licensure Commission.
  • Any government agency’s investigation, enforcement, or other action.

Binding on Minor Students

A parent or legal guardian accepting these terms on behalf of a minor student agrees to this Dispute Resolution section on the minor’s behalf and binds the minor to it, except where the law does not permit such binding.

Severability

If any part of this Dispute Resolution section is held unenforceable, the rest survives. If the class action waiver is held unenforceable for a particular claim or remedy, that claim or remedy may proceed in court, not in arbitration, but everything else in this section continues to apply.

11.  Indemnification and Liability

Indemnification. You will indemnify and hold harmless Dual Academy Corp. and its officers, directors, shareholders, employees, faculty, contractors, volunteers, successors, and assigns from third party claims, losses, and reasonable costs arising from the student’s or your breach of these terms, violation of Dual Academy policy or law, or wrongful or negligent acts.

Limitation of liability. To the fullest extent permitted by law, the total liability of Dual Academy Corp. and its officers, directors, shareholders, employees, faculty, contractors, volunteers, successors, and assigns arising out of or relating to enrollment is limited to the tuition paid for the then current semester. Dual Academy is not liable for indirect, incidental, consequential, special, or punitive damages. Nothing in this section limits liability that cannot be limited by law.

No guarantee of outcomes. Dual Academy does not guarantee any particular academic result, grade, rate of progress, scholarship, financial aid, admission to or acceptance of credit by any other institution, or employment.

12.  Governing Law

These terms are governed by the laws of the District of Columbia, without regard to conflict of laws principles. Internal corporate matters of Dual Academy Corp., such as stockholder, director, or governance matters, are separately governed by the laws of the State of Delaware under its Bylaws and Certificate of Incorporation, and these terms do not change that.

These terms, together with the Student and Family Handbook and the Privacy Policy, are the entire agreement between you and Dual Academy regarding Flex enrollment, and supersede all prior or contemporaneous statements, marketing, brochures, and oral representations.

We may issue updated versions of these terms. The version in effect when you enrolled governs your current semester. Continued enrollment after notice of an update constitutes acceptance for later semesters.
