We use personal information for purposes including the following:
Any research use of personally identifiable education records complies with the student records standards described in Section 4 and with applicable law and, where required, is subject to appropriate consent or de-identification safeguards before sharing.
De-identified or aggregated information that cannot reasonably be used to identify an individual is not subject to this Policy and may be used and shared for any lawful purpose.
We do not sell personal information. We do not use student education records for advertising or marketing to third parties. We do not use class recordings for advertising or marketing. We may use contact information provided by parents, guardians, and alumni to communicate about Dual Academy’s own programs, events, and mission-related activities.
We share personal information in the following circumstances, and as otherwise permitted by applicable law:
School Officials
We disclose education records to Dual Academy faculty, administrators, advisors, and contracted staff who have a legitimate educational interest in the records, without prior consent.
NewU University
Dual Academy classes are NewU University classes. Student academic records and enrollment data are shared with NewU Inc., doing business as NewU University, to register students, deliver instruction, assign credits, and comply with accreditation and articulation requirements. NewU Inc. is designated a school official with a legitimate educational interest for this purpose under our agreement with it. NewU Inc. is the custodian of class recordings and of the NewU University transcript, as described in Sections 4 and 5. NewU Inc. is contractually required to handle shared student records under appropriate confidentiality standards and is subject to its own privacy policy, published at newu.university/privacy.
Partner Schools
Some students enroll in a la carte college classes through their own school, which purchases enrollments from us. Where the parent or legal guardian has consented, we share that student’s progress information with their school. Partner schools do not receive class recordings. A partner school is responsible for obtaining the consents required before a student’s first session.
Service Providers & Research Partners
We engage vetted vendors and authorized research organizations, for example learning management system providers, video conferencing platforms, remote proctoring providers, payment processors, cloud hosting, assessment developers, and curriculum researchers, who process information on our behalf under written agreements that restrict independent use and require appropriate safeguards.
Legal & Safety Disclosures
We may disclose information when required by law, subpoena, court order, or government authority, or when necessary to prevent imminent harm to a student or others.
Accreditation, Government & Audits
We may share student records and other information with accrediting organizations, state and federal education agencies, and auditors as required for program compliance, licensure, or reporting obligations, without prior consent where permitted by applicable law.
Business Transfers
In connection with a merger, acquisition, reorganization, or sale of all or a portion of our assets, personal information may be transferred to a successor entity. Any successor entity is required to honor the commitments made in this Privacy Policy with respect to personal information collected before the transaction, subject to applicable law.
Dual Academy handles student education records in accordance with the Family Educational Rights and Privacy Act (FERPA). We apply the FERPA standard as a matter of school policy and by contract, and we hold ourselves to it whether or not it applies to a private school by statute. Our practices on student records are:
Records Held by NewU University
Because Dual Academy students are also enrolled in NewU University classes, NewU Inc. holds the postsecondary education record for those classes, and is the custodian of class recordings. Rights in a postsecondary record belong to the student regardless of the student’s age. A parent of a minor student who wants access to a NewU record obtains a signed release from their child.
State Student Data Privacy Laws
Where a student resides in a state with student data privacy statutes that exceed Dual Academy’s baseline standards, for example California, Colorado, Connecticut, Illinois, and New York, we comply with the applicable requirements of that state’s law.
We record class lectures in video and audio for academic and safety purposes, and so that students may review a class they attended or could not attend. Only lectures are recorded. Advising, wellbeing, and disciplinary conversations are not recorded.
What a Recording Captures
Dual Academy classes are NewU University classes taught by NewU professors in NewU University classrooms that connect students attending online with students attending in person. Those classrooms use a 360 degree camera and microphone placed among the seats. A recording of a lecture with in-person attendance therefore captures the classroom and the people in it, including students other than your own, and includes their faces, voices, names, and what they say during the lecture. Your student may share a class with adult NewU University degree students and with students in Dual Academy’s other programs.
Google Meet displays an on-screen indicator to everyone in the session for as long as recording is active, so anyone present can see that a lecture is being recorded.
Cameras
A student attending a lecture live is expected to have their camera on, because a class is a discussion rather than a broadcast. A student in a program that permits attendance by recording may instead attend by watching the recording, subject to the assignment and assessment deadlines for the class. Where an accommodation under Policy 34 of the Student and Family Handbook adjusts the application of the camera rules, the accommodation is honored without disclosure of the underlying condition to peers.
Who Holds Recordings
NewU Inc., doing business as NewU University, is the custodian of lecture recordings. They are stored in NewU Inc.’s Google Workspace for Education environment with sharing restricted. They are not public, not posted to the internet, and not searchable.
Who Can Access Them
The professor of the class, the students enrolled in that class, and designated academic administrators of NewU University and Dual Academy. A student may watch a recording of a class in which the student is enrolled. A student may not download, copy, re-post, or share a recording with anyone outside the class.
How Long We Keep Them
Lecture recordings are retained for one academic year and then deleted, unless a recording must be preserved for an investigation or as required by law. This period applies specifically to lecture recordings and replaces the general records retention periods in Section 7. It matches Policy 15 of the Student and Family Handbook.
What We Do Not Do With Them
We do not sell lecture recordings. We do not use them for advertising or marketing. We do not use them to train artificial intelligence or machine learning models. Using classroom footage or a student’s image publicly, on a website, in a brochure, or on social media is a separate matter that requires prior written consent under Policy 24 of the Student and Family Handbook, and you are free to decline.
Exams and Proctoring
Some classes include exams or quizzes taken online, and Dual Academy may use remote proctoring software for those assessments. Remote proctoring runs inside the Chrome browser and may record the student’s webcam, microphone, and screen during the assessment, and may limit other browser activity while the assessment is open. The specific software in use, what it records, who may review it, and how long its recordings are kept are published at dualacademy.org/tech, and a class that uses proctoring says so in its syllabus. Proctoring recordings are education records. They are not sold, are not used for advertising or marketing, and are not used to train artificial intelligence or machine learning models.
Your Requests About Recordings
You may ask what recordings exist of your student, ask to review them, or ask us to delete one. Write to [email protected] and we respond within a reasonable time, and in any event within 45 days. If we cannot delete a recording, for example because it is also another student’s education record or must be preserved for a safety matter or by law, we tell you why.
Dual Academy enrolls students age 15 and older. Full-time students are in Grades 11 and 12, generally ages 16 to 18. A la carte students may be age 15 and up, including students enrolled at other primary schools and students who are legal adults.
We do not knowingly collect personal information online from children under 13 without verified parental consent. If we become aware that we have inadvertently collected personal information from a child under 13 without appropriate parental consent, we delete that information promptly.
For a student under 18, the parent or legal guardian is the contracting party at enrollment, and by accepting the enrollment terms provides the consents this Policy describes, including consent to lecture recording under Section 5. Where a student enrolls through a partner school, that school obtains those consents from the parent or legal guardian on our forms.
Parents or guardians may review or request correction of their minor child’s personal information by contacting us at [email protected]. Requests affecting student education records are governed by Section 4 and are subject to our legal retention obligations. We are not able to delete an education record on request where retention is required by law or accreditation standards.
We retain official academic transcripts and diploma records permanently, as these may be needed to verify credentials throughout a student’s lifetime. All other student education records are retained for a minimum of seven years after graduation or withdrawal, or longer as required by applicable law or accreditation standards. Financial records are retained as required by tax and audit obligations.
These periods do not apply to lecture recordings or to proctoring recordings. A lecture recording is retained for one academic year and then deleted, as described in Section 5. A proctoring recording is retained for no longer than one academic year and then deleted, and the period actually in force, together with the software in use, is published at dualacademy.org/tech.
We implement reasonable administrative, technical, and physical safeguards, including encryption in transit (TLS), access controls, and regular security reviews, to protect personal information against unauthorized access, disclosure, or destruction. No system is completely secure. In the event of a breach affecting your information, we will notify you without unreasonable delay and in accordance with applicable law, and we will notify NewU Inc. and any affected partner school as required by our agreements with them.

Dual Academy collects mobile phone numbers when users voluntarily provide them by submitting a form on dualacademy.org that requests consent to receive text messages. We use mobile numbers to send communications related to a student’s interest in or enrollment with Dual Academy, including admissions, financial aid, classes, payments, academic progress, events, and related program updates.
Message frequency varies based on the user’s stage in the admissions and enrollment process. Message and data rates may apply.
You may opt out of text message communications at any time by replying STOP to any message. Reply HELP to any message for assistance, or contact us at [email protected].
Mobile phone numbers and text message opt-in consent data are not sold, rented, or shared with third parties for those third parties’ marketing or promotional purposes. Mobile data may be processed by service providers acting on Dual Academy’s behalf, such as our messaging platform and CRM provider, shared with NewU University in connection with their NewU enrollment, or disclosed as required by law.
For students under 18, Dual Academy directs text message communications to the parent or guardian phone number provided. Parents or guardians may contact us at [email protected] to revoke text message consent at any time.
